LOGAN — A preliminary hearing has been scheduled for Heidi Marie Rutchey. The 45-year-old River Heights mother charged in the death of her two-year-old son, more than three-years ago.
Court records show, Rutchey appeared in 1st District Court Monday morning with defense attorney David Perry. He asked the court for a preliminary hearing, where state attorney’s will present evidence in the case and a judge will determine if there is sufficient evidence to show the crime was committed.
Judge Thomsas Willmore scheduled the hearing for January 18 at 1:30 p.m.
Two-weeks ago, Rutchey was found competent to stand trial after receiving treatment in the State Mental Hospital since January 2014.
Rutchey was arrested on a first-degree murder charge in October 2013. A month earlier, on September 4, she was driven to Logan Regional Hospital for an undisclosed medical issue. After being checked into the hospital, questions arose concerning her son Eli’s condition. Medical staff called police dispatch and requested a welfare check for the child at a River Heights apartment near 400 S. 400 E. When Cache County Sheriff’s deputies arrived at the location, they found the toddler dead inside.
Rutchey has been ordered to remain in the State Mental Hospital so that she can continue receiving treatment, while the case against her proceeds.
