LOGAN — A 43-year-old River Height’s mother remains in the Utah State Hospital, reportedly still incompetent to stand trial in the death of her two-year-old son.
Defense attorney David Perry appeared in 1st District Court Monday for Heidi Marie Rutchey’s review hearing.
Perry said hospital administrators told him, they have not been able to restore Rutchey’s competency and she remains in Orem, receiving treatment.
Rutchey has been hospitalized since being found incompetent on January 27, 2014. She was arrested on a first-degree murder charge, October 24, 2013.
Eli Rutchey was found dead in his home by Cache County Sheriff’s deputies, September 4. Earlier that day, Rutchey was driven to Logan Regional Hospital for an undisclosed medical issue. After she was checked into the hospital, questions arose concerning Eli. Medical staff called police dispatch and requested a welfare check for the child at a River Heights apartment near 400 South 400 East.
During Monday’s review hearing, Judge Brandon Maynard scheduled another review hearing, January 25, 2016 to assess if Rutchey can then stand trial.
